Trooper Matthew Ruthier put his hand out in an attempt to avoid getting seriously hit.
From there Herrera allegedly fled toward Route 495 where his vehicle crashed with a police cruiser.
According to the prosecutor, Herrera told the police, "I am sorry, I was scared."
Herrera is facing drunk driving and assault charges. He has been ordered held pending a dangerousness hearing next Tuesday.
