No Bail For Man Charged In Fatal Chatham Pedestrian Crash
CHATHAM (CBS) -- The driver accused of killing a man at a Cape Cod bus stop is behind bars, held without bail.
It was Saturday afternoon, when Harwich police tried to stop 32-year-old Benjamin Shealey on Rt. 28.
Police say he blew a tire, trying to get away and continued on into Chatham.
"They saw him driving erratically and our officers backed off," said Harwich Police Chief Bill Mason.
Once in Chatham, and without a right front tire, police say Shealey crashed into a parking lot at the Kreme and Kone, where 62-year-old Albert Della Malva was waiting for a bus. He was killed almost immediately.
A family of four, in their car, was injured.
After court, Shealey's uncle said, "He's confused, he doesn't know there's been a death or an accident. But we want to apologize to the family," said Frank Shealey.
Shealey comes from a well-known Chatham family but his name isn't keeping him out of jail.
Shealey has been charged with failure to stop for police and other motor vehicle violations. Chatham Police say additional criminal charges - including vehicular homicide - are expected.
He'll be back in court on Wednesday for a dangerousness hearing.
