No Bail For Brockton Man Charged With 9th OUI
AVON (CBS) - A Brockton man charged with driving under the influence of alcohol for the ninth time is being held without bail after his arraignment Monday from his hospital bed.
William D. Doten, 65, was arraigned on OUI-5th (and subsequent), and driving after license suspension.
Massachusetts laws do not have separate charges for OUI over five times. After a person's fifth OUI, they are charged with OUI-5th (and subsequent), according to the Norfolk County District Attorney.
Doten pleaded not guilty before Judge Richard Savignano.
Police say Doten and his friend Joseph Doyle had been driving around for hours Thursday night and ran out of gas. Doyle, who was also allegedly drunk, called 911 to report their truck had broken down and that they were lost.
As police approached, they smelled alcohol and saw open bottles of vodka and beer in the passenger compartment.
Doyle was given a ride home by police officers and Doten was arrested and brought to the hospital.
Doten was found guilty on five previous drunk driving charges, enough for the state to issue a lifetime revocation of his license.
Police say since that revocation order, Doten has been arrested several times for driving with a revoked license.
A dangerousness hearing will be held Jan. 23.
