Neil Entwistle Asks SJC For New Trial

BOSTON (CBS) – Neil Entwistle is looking for a new trial and his attorney went to the highest court in Massachusetts to make their case Friday.

Entwistle is serving a life sentence for the murders of his wife and infant daughter at their rented Hopkinton home in 2006.

His lawyer, Stephen Maidman, argued before the Supreme Judicial Court Friday that evidence taken from the Entwistle's home was seized illegally because police did not have the right to search the home without a warrant.

Police found the bodies in the home conducting a second well-being check at the house.

Maidman said because police did not have a search warrant, the evidence found at that time should have been suppressed.

Prosecutor Casey Silvia told the justices Friday police were doing exactly what they had to do.

The case was taken under advisement.

There's no word when the SJC will rule on Entwistle's request.
