Dwayne Moore faces first-degree murder charges in the shooting deaths of four people, including a two-year-old boy, back in September 2010.
Jurors heard testimony Monday from the only survivor, Marcus Hurd, who was left paralyzed after being shot in the back of the head.
Hurd testified that he saw the shooter.
He had testified in Moore's first trial that he did not see his shooter. That trial ended in acquittal for one suspect and a mistrial for Moore.
Hurd then changed his story and testified in the second trial that he did recognize Moore as the shooter.
Hurd did not identify Moore as the shooter in the first trial, he says, because he was following "street code."
