Todd Brunner, 44, was taken into custody by state police after being stopped in Burlington. He was charged with DUI.
He was offered one phone call, and called his wife. The problem is it was his estranged wife, who had a restraining order out against him.
"I think it was inadvertent. He wasn't thinking, possibly under the influence, I don't know, but I don't think he meant to be harassing," said William Barabino, Brunner's lawyer.
Besides the DUI, Brunner faces two counts of violating the restraining order, which bars any contact with his wife. The second charge is because he talked with their child, who answered the phone.
