Kristen LaBrie, Mom Convicted Of Withholding Son's Medicine, Gets New Trial

BOSTON (AP) — Massachusetts' highest court has granted a new trial to a woman convicted of withholding potentially life-saving medications from her cancer-stricken son.

Kristen LaBrie was convicted in 2011 of withholding at least five months of at-home chemotherapy treatments for her son, Jeremy Fraser. The 9-year-old died in 2009.

LaBrie was sentenced to eight to 10 years in prison.

The Supreme Judicial Court on Wednesday reversed a judge's order denying her motion for a new trial on an attempted murder charge. The court also overturned assault and battery charges but upheld a charge of reckless endangerment of a child.

LaBrie said she stopped giving Jeremy medications because the side effects made him extremely ill.

A spokeswoman for the Essex County district attorney's office says they are still reading the decision.
