Kmart Loses Fitchburg Family's Layaway Order

FITCHBURG (CBS) - A Fitchburg couple said the local Kmart stole their Christmas cheer when they lost their layaway order.

In early October, the Thayers did all their Christmas shopping at Kmart in Fitchburg. They made their payments and when they went to pick-up the items, they said they were told the items were gone.

"She came back out and said oh your stuff is lost," said Rich Thayer.

The gifts were for their four children ages 5, 6, 8 and 9.

"I don't want to disappoint my kids they're really good kids," said Heidi Thayer.

"The contract was I pay you - you hold the stuff and give it to me when I pay it off. They couldn't hold their side of the contract," said Rich Thayer.

Kmart refunded the more than $400 they had paid and gave them a $25 gift certificate.

The Thayer's said the store did not make an effort to find the misplaced items.

"Technically walked away with my kids Christmas and that's not O.K.," said Heidi Thayer.

The Assistant Store Manager admitted what happened to the couple has "happened a couple times." When asked what the store is doing to remedy the situation - the response was "no comment."
