Judge denies request in burglary killing trial
A New Hampshire judge has denied a request by lawyers for a man charged with a home invasion and killing of a Mont Vernon, N.H., woman to move his trial to another location.
The lawyers for Steven Spader asked for a change of venue, saying voluminous articles written about the case of Kimberly Cates was prejudicial and hostile in tone toward Spader, whose first-degree murder trial is scheduled for Oct. 13. Spader has pleaded not guilty in the killing of Kimberly Cates and serious injury of her 11-year-old daughter, Jamie Cates.
Judge Gilllian Abramson ruled Thursday that Spader's lawyers haven't produced enough evidence to show deep hostility in the Hillsborough County judicial district or that pretrial publicity surrounding his case and other defendants was prejudicial.
