Former MIT Student Charged In BU Rape Released On $10,000 Bail
BOSTON (CBS) – A former Massachusetts Institute of Technology student charged with raping a Boston University student while she slept inside her dorm room is free after he posted $10,000 bail.
Samson Donick was arraigned Wednesday in Suffolk Superior Court a day after he was indicted on charges of aggravated rape, breaking and entering at night with the intent to commit a felony, burglary, and indecent assault and battery.
The charges were in connection to a reported October 2015 rape in StuVi2, a Boston University dorm room on Harry Agganis Way.
A 20-year-old student reported to police that she woke up in her room to find Donick sexually assaulting her. She told police Donick ran out of the room when she screamed.
"And there was an unknown college aged white male on her bed next to her she told the male to stop and he responded by saying 'baby do you want some more,'" prosecutor Lynn Feigenbaum said. "She was able to sit up and pull her blanket up over her, and yelled at the male to leave the room."
Investigators say they tracked Donick down with surveillance images. They say he was originally signed into the dorm by two male students but then entered ten other rooms. One student who was not assaulted does remember an intruder.
"I'm pretty sure the trash can was knocked over then he like shined a flashlight like his iPhone flashlight and then he left and then he came back, and then he left again," the student said. "But again it was the middle of the night we didn't think much of it."
Donick's defense lawyer says there is reasonable doubt.
"The Commonwealth knows they have serious problems of proof in this case," Norman Zalkind said. "So I just want to make it clear because the press is here, the audience is here there's two sides to this case and we're looking forward to a jury trial in this case."
Donick was ordered to surrender his passport, have no contact with the alleged victim or witnesses, stay away from the BU Campus, and remain outside of Massachusetts.
A trial date of Feb. 8, 2017, trial date was set during the arraignment. Donick is next scheduled to appear in court on June 22.
