Jury Deliberates Damage Amount In Midei Wrongful Stent Suit
TOWSON, Md. (WJZ) -- Millions of dollars are at stake, and now, it's all in the hands of a Baltimore County jury.
It is the same jury that earlier found Dr. Mark Midei performed an unnecessary stent procedure on Maryland businessman, Glenn Weinberg.
Alex DeMetrick has more on the final stages of the case.
Closing arguments came earlier than expected and wrapped up around 5 p.m. Friday.
Blocked arteries can cause heart attacks and deaths. Opening those vessels with stents can lessen that risk.
But placing those stents when they are not needed has led to hundreds of lawsuits against former cardiologist Dr. Mark Midei.
"Dr. Midei said it was 90 percent. And after they reviewed everything, it was 10 percent," said former patient, Vicki Marrs.
Most of those suits have been settled out of court. Last month, a jury found Dr. Midei placed unnecessary stents in businessman Glenn Weinberg's heart.
Fearing he had severe heart disease, Weinberg cut back his work as a partner with Cordish Companies, saying the false diagnosis cost him a four percent stake in four Cordish projects.
But in an effort to streamline the case, the jury is only considering the Maryland Live! Casino in the damages phase of this case.
Midei's defense insists he saved Weinberg's life and he is not responsible for Weinberg's subsequent decisions.
In instructing the jury, the judge laid out three basic questions for the jury to settle: Did Glenn Weinberg lose an interest in Maryland Live!? What was the amount of the loss? And Dr. Midei's negligence must have been the case for the injury claim.
Losses suffered by Glenn Weinberg are estimated between $50 and $150 million. It's now for the jury to set an actual damage amount.
Besides Dr. Midei, the former owners of St. Joseph Medical Center are also defendants in the lawsuit.
