U.S. Appeals Court Rejects Stun Gun Death Retrial
FREDERICK, Md. (AP) -- A federal appeals court is rejecting a Frederick family's quest for a new trial in the electronic stun gun death of their son.
The Frederick News-Post reported Thursday that three judges from the U.S. Court of Appeals in Richmond have ruled the parents of Jarrel Gray are not entitled to a new trial.
The panel disagreed with the family's contention that a jury in Baltimore delivered an incorrect verdict in 2012.
The jury found that a former Frederick County sheriff's deputy did not use excessive force when he shocked the 20-year-old man twice while responding to an outdoor disturbance in 2007.
Gray's autopsy report lists the cause of death as undetermined, associated with restraint and alcohol intoxication. The stun gun is the only type of restraint mentioned in the report.
