No Criminal Charges For Driver In Bicyclist Crash That Killed Annapolis HS Track Coach
ANNAPOLIS, Md. (AP) -- A motorist won't face criminal charges in an August accident that killed an assistant track coach at Annapolis High School.
Anne Arundel County prosecutors announced Friday that a grand jury has declined to indict Whitney Decesaris. She will be charged with negligent driving and other traffic offenses.
Decesaris, 37, was behind the wheel of a minivan that struck Patricia Cunningham, 50, while Cunningham was riding her bicycle on Riva Road in Davidsonville. Cunningham later died at a hospital.
State's Attorney Anne Colt Leitess says the accident was tragic, and she points out that Maryland's manslaughter law excludes acts of ordinary negligence. She notes that her office "continually lobbies for a more appropriate legal standard or proof for negligent manslaughter."
An attorney for Decesaris could not immediately be located.
