Md. Man Convicted In Baby Death Wants New Trial
HAGERSTOWN, Md. (AP) -- A Maryland man serving 30 years for shaking his girlfriend's infant son to death in 2007 is seeking a new trial.
The Herald-Mail of Hagerstown reports that Floyd Bingaman, 26, was back in Washington County Circuit Court on Friday to make the request. A jury convicted Bingaman of involuntary manslaughter and first-degree child abuse in the death of 4-month-old Justice Myers-Cannon
In 2010, after his conviction, Bingaman claimed errors by his defense lawyer and prosecutors and sought a modified sentence, release from prison or a new trial. Washington County Circuit Judge Donald Beachley denied those claims. But on Friday, Bingaman's attorney Daniel Ginsburg asked Beachley to reopen the post-conviction proceeding.
Beachley said he would rule within 30 days.
