Defense Wants Statements, Phone Records Excluded In Kidnapping Case
ELKTON, Md. (AP) -- The defense for a man charged with of kidnapping and killing an 11-year-old girl have asked that his cell phone information and statements he made to police be kept out of evidence.
The request came during a hearing in Cecil County Circuit Court for Thomas James Leggs Jr., 31, on Thursday.
Defense attorney Kay Beehler says cell phone records and data obtained by the police violate Leggs' constitutional right to privacy and jurors may perceive a statement Leggs made to police as an implication of guilt. The judge is expected to rule on Friday.
Leggs is charged with murder and other offenses in the kidnapping and slaying of Sarah Foxwell. Her burned remains were found Christmas Day 2009 in Wicomico County.
