Court Revives Lawsuit Over CBF Building Problems
ANNAPOLIS, Md. (AP) -- A federal appeals court has revived a lawsuit over construction problems at the Chesapeake Bay Foundation's headquarters in Annapolis.
The court last week overturned a lower court decision granting summary judgment to Weyerhauser Co. which provided certain materials used in the "green" design and construction of the CBF's Philip Merrill Environmental Center.
The design called for the use of exposed structural wood members called Parallams, which consist of strips of wood that are bonded together and coated with a sealant. But shortly after the building was finished, water began leaking into the building through the Parallams, which were later found to be rotting.
The appeals court said the lower court erred in ruling that a 2010 lawsuit by the foundation and its design and construction firms was filed too late.
