Court Overturns Conviction In Ranger's Death
ANNAPOLIS, Md. (AP) -- Maryland's highest court has ordered a new trial for a former U.S. Army Ranger who was convicted of killing his roommate, another ranger, in 2006.
The Court of Appeals ruled Tuesday that Gary Smith must be allowed to introduce testimony regarding Michael McQueen II's purported suicidal depression.
Smith was convicted in 2008 of shooting McQueen II, 22, on Sept. 26, 2006 in the apartment they shared in Gaithersburg. He was found guilty of second-degree murder.
Montgomery County State's Attorney John J. McCarthy tells The Daily Record of Baltimore that Smith will be retried.
