Convicted Killer Won't Have To Pay Restitution
ELKTON, Md. (AP) -- A judge has ruled a man who stabbed a widower dozens of times does not have to pay restitution to the dead man's family.
Cecil County Circuit Court Administrative Judge V. Michael Whelan ruled Monday that John Wayne Davis, 31, does not have to pay $20,000 to the relatives of John R. Fleming, 71.
That sum would cover funeral expenses and other costs.
The Cecil Whig reports that Whelan said Davis' circumstances do not meet standard factors in deciding such cases. He said Davis has no income, no assets and is serving a life sentence.
Davis pleaded guilty to first-degree murder in the slaying of Fleming during a robbery in December 2010.
