FORT WORTH (CBSDFW.COM) - A Fort Worth Police officer was indicted Tuesday for shooting a man holding a barbecue fork outside his parents' house in June 2015.

The officer's attorney says the shooting was an accident.

Officer Courtney Johnson was dispatched to the home because of reports of a man with a knife breaking into homes.

Police say Officer Johnson discharged a shotgun, hitting 55-year-old Craigory Adams in the arm.

Adams' mother told CBS11 what she saw after the shooting.

"My son laying on the ground in the driveway rocking like this on his back and I saw this man standing over him," says Jeanette Adams.

The parents also told CBS11 their son is bipolar and in a nursing home right now because he wouldn't take his medicine.

They say the shooting was no accident.

Craigory Adams filed a civil lawsuit against Johnson late last year, asking for at least $200,000 in damages, but less than a million dollars.

He says in the lawsuit that the officer was negligent in his duties and because of that negligence, he now has "significantly impaired movement and use of his right arm, due to serious nerve damage."

Officer Johnson was indicted on the charge of Aggravated Assault by a Public Servant.
