DALLAS (CBSDFW.COM) - Police say a Dallas County Constable shot a male suspect while trying to break up a fight early Friday morning.

The shooting happened just before 2 a.m. in the parking of a strip mall outside The Draft House on Rosemeade Parkway, near the George Bush Turnpike.

Evidence markers were still on the ground as sunrise approached. Investigators say two men had been fighting inside The Draft House and the fight spilled out into the parking lot.  When the Constable began speaking to one of the men involved a shot was fired.

The Constable, who has not been identified, was off-duty but in uniform working security at The Draft House. A witness said he could hear the men arguing and the deputy telling one man to drop a gun.

Police say the suspect fired his weapon -- shattering the glass of a nearby Aio Al's Pizza restaurant. The constable returned fire, hitting the suspect.

Tareq Statieh, the co-owner of Zio Al's, was inside when the bullet flew through the window. He says there's been trouble in the parking lot before. "People come in, they try to fight, try to argue. We get that every Thursday. I've seen some fights but not like this."

The suspect who was shot was taken to an area hospital where police are questioning him. His injuries are not life threatening. The other man involved in the fight ran from the scene and has not been located.

The Constable was not injured.
