28-Year-Old Dies Following Dallas Shooting, Police Sending Case To Grand Jury

DALLAS (CBSDFW.COM) — A case involving the death of a 28-year-old after a shooting Saturday morning will be going to a grand jury, police say.

Dallas police responded to the shooting in the 2700 block of Howland Street around 2:15 a.m. Investigators say the victim, Noe Pena, pointed a handgun at the 31-year-old suspect during a "disturbance," and "the suspect produced his own handgun and defended himself."

Pena died from his injuries at Parkland Hospital, according to police. The suspect also had gunshot wounds, and he checked himself into a local hospital with non-life-threatening injuries, investigators say.

Police said a homicide offense for the case will be referred to a grand jury. Since the suspect was not charged and booked, police did not release his name.
