Sunnyvale's Ban On Large Ammunition Magazines Goes Before 9th U.S. Circuit Court Of Appeals
SUNNYVALE (KCBS)— A group of Sunnyvale gun owners – backed by the National Rifle Association – are set to urge the 9th U.S. Circuit Court of Appeals to invalidate the city's new law— Measure C, which was overwhelmingly passed by voters last year.
The law bans anyone from owning a magazine that can hold more than 10 rounds of ammunition. Tony Schoemberg is an attorney representing the city of Sunnyvale.
"Their claim is that the law violates the right to bear arms under the Second Amendment of the U.S. Constitution. Our position is that it doesn't," he said. Schoemberg argued that rulings on similar laws around the country are coming in, upholding the gun restriction laws and finding them to be constitutional.
The decision by the appeal's court could have wide ranging implications. Since the law was passed, several other California cities including Mountain View, San Francisco and Los Angeles have adopted similar ordinances limiting the size of ammo magazines.
