Video Surfaces Of Deputy's Arrest For Pulling Gun At Santa Clara Jack In The Box

SANTA CLARA (CBS SF) -- A recently posted YouTube video shows the January arrest of a Santa Clara County sheriff's deputy after he allegedly pulled a gun on Jack In The Box employees.

Veteran Santa Clara County sheriff's deputy Benjamin Lee was arrested back in January for allegedly pulling a gun on two fast food workers and for driving under the influence.

But a YouTube video captured by bystanders was only recently posted online and shows the arrest.

The YouTube video is narrated by two anonymous bystanders. The clip was posted on July 22 by user Luber Late Nights.

Authorities said Lee had a meltdown over the long line at 2:40 a.m. after a night of drinking with friends. Witnesses said he was angry and pointed a gun at a clerk and manager.

The 911 call came in from terrified Jack In The Box workers reporting a man with a gun. Police with a k-9 unit responded to the restaurant and took Lee into custody at gunpoint.

Lee, who driving the car, was not on-duty at the time. He had two passengers in the car with him, and the video shows them all eventually getting out of the car with their hands up.

Santa Clara police said Monday that they had no idea Lee was with law enforcement when they pulled up to the scene. And they said they wouldn't have acted any differently if they had known he was a deputy.

The Santa Clara County Sheriff's Office placed Lee on administrative leave immediately after the arrest and are conducting an internal investigation.

Lee is due in court this week.
