Marin County Tech Executive Sentenced To 90 Days In Jail For Cyclist Road Rage Incident

MARIN CO. (CBS SF) -- A Kentfield cyclist who attacked a driver during a traffic dispute was sentenced to 90 days in county jail Wednesday by a Marin Superior Court judge.

Jeffrey Smock, 41, was riding a bicycle in the area of Camino Alto Avenue and East Blithedale Avenue on April 16 2014 when he was clipped by the rear-view mirror of a passing truck. Smock caught up with the 55-year-old truck driver, Roman Laskowski, and began to beat him as witnesses yelled and honked their horns.

According to the San Francisco Chronicle,  Smock was charged with two felonies -- assault likely to cause great bodily injury and battery resulting in significant injury. He pleaded not guilty but a jury convicted him of the latter charge in June.

"He's not happy that he's going into custody, but that's what's going to happen," Smock's attorney Gerald Schwartzbach told the San Francisco Chronicle.  "This whole thing took less than 21 seconds in the life of a man who is 41 years old with a wife and kids."

Schwartzbach said Smock, who founded the Virginia-based Iron Data software company and previously ran LightNetwork, will likely appeal his conviction.
