Ex-Convicts Charged In Marijuana Deal Murder In Oakland Parking Lot

OAKLAND (CBS SF) -- Two ex-convicts have been charged with murder for the fatal shooting of an Alameda man in the parking lot of a Walmart store in East Oakland in December that police said took place during a marijuana deal.

Shawndale Boyd, 30, of Hayward, and Damion Sleugh, 26, of Oakland, are also charged with the special circumstance of committing a murder during the commission of a robbery in connection with the shooting of 24-year-old Vincent Muzac, who was found dead in the parking lot of the Walmart at 8400 Edgewater Drive at about 12:35 p.m. on Dec. 22.

The special circumstance allegation means Boyd and Sleugh could face a sentence of life in prison without the possibility of parole if they are convicted.

In addition, Sleugh faces two counts of possession of a firearm by a felon, one for the killing and the other from a loaded sawed-off shotgun that was found in his home when he was arrested, according to court documents.

Oakland police Officer Phong Tran wrote in a probable cause statement that evidence and witness accounts indicate that Boyd and Sleugh were with Muzac shortly before the fatal shooting and that they conspired to rob him of "a large quantity of marijuana."

Tran said it appears that Boyd arranged an illegal marijuana sale from Muzac to Sleugh.

The officer said Muzac met the two suspects in the Walmart parking lot and then Boyd directed Muzac to Sleugh, who is believed to have shot Muzac and robbed marijuana from him.

Sleugh and Boyd then fled from the scene with the stolen marijuana, according to Tran.

Boyd was arrested in San Leandro on Feb. 19 and Sleugh was arrested at his home in Oakland on Feb. 13, according to police.

The Alameda County District Attorney's Office alleges that Sleugh has two prior felony convictions, one for robbery in Alameda County in April 2008 and one for grand theft in Contra Costa County in December 2006.

Prosecutors allege that Boyd also has a prior felony conviction, for possession of cocaine for sale in Alameda County in March 2003.

The prior convictions could increase the length of both men's state prison terms if they are convicted.

Boyd and Sleugh are both being held in jail without bail and are scheduled to return to Alameda County Superior Court on March 10 to enter pleas.
