Court Won't Reconsider Morgan Hill School's US Flag Shirt Ban During Cinco De Mayo
SAN FRANCISCO (CBS/AP) — A federal appeals court won't reconsider a ruling that upholds a Morgan Hill high school's decision to order students to turn American flag T-shirts inside out.
The high school in the San Jose suburb of Morgan Hill issued the order during a celebration of the Mexican holiday Cinco de Mayo. The school had a history of problems between white and Latino students.
The 9th U.S. Circuit Court of Appeals said Wednesday that a majority of its judges voted against rehearing the case.
A unanimous three-judge panel in February said past problems gave school officials sufficient and justifiable reasons for their actions. The court said schools have wide latitude in curbing certain civil rights to ensure campus safety.
