Delco Man Fired From Chipotle Over Tweets Wins Labor Ruling

PHILADELPHIA (CBS) -- A Delaware County man has won his battle with Chipotle over tweets that led to firing.

James Kennedy was fired from his job at Chipotle in Havertown last year after he tweeted about wages and started a petition asking for management to allow workers to take their breaks.

His case was taken up by the Pennsylvania Workers Organizing Committee and on Monday a judge found that Chipotle's social media policy violated the National Labor Relations Act.

"It worked out really well. They have to give me my job back or pay me the difference in wages. They have to change their social media policy so that people can tweet what they want as long as its not threatening or malicious speech."

Kennedy, a three time war vet, has no plans to return to Chipotle.

"I got a really good job at the airport now. I am union, to go from an at will employee to a union is like night and day. the culture is completely different."

A lawyer for Chipotle had no comment.
