Jerry Sandusky To Make Case For State To Restore His Pension Benefits

HARRISBURG, Pa. (CBS) - Jerry Sandusky will be the focus of another official proceeding today. This time, Sandusky is appealing to a state agency in an effort to have his pension restored.
Sandusky is scheduled to appear via a video feed as SERS – the State Employee Retirement System – hears his appeal of the decision to deny his pension benefits. SERS officials declined to be interviewed for this story but Stephen MacNett – former longtime general counsel to state Senate Republicans – says a law was enacted in the 70s to deny benefits for state pensioners who committed job-related crimes of a "feathering one's nest" variety.
"Forgery, embezzlement, what you might call official conduct type offenses."
MacNett says the law was amended in 2004 to include school employees who committed sexual crimes against students. But he says that change affected PSERS – the Public School Employees Retirement System -- and Sandusky is in a different pension fund.
