Bill Cosby Back In Courtroom For Pre-Trial Meeting

MONTGOMERY COUNTY (CBS) -- Bill Cosby is due in a Montgomery County Courtroom Tuesday afternoon, for a pre-trial conference on charges he drugged and molested a woman in his Cheltenham mansion in 2004.

Bill Cosby's lawyers argue a jury should never hear the recording of a phone call between Cosby and the mother of his accuser.

They say Cosby never gave consent to being recorded, and that violates Pennsylvania law. Prosecutors say the recording is legal and admissible as it was made in Canada, where both parties don't need to consent.

The defense also wants a deposition Cosby gave in 2005 and 2006 in connection with a civil lawsuit to be suppressed.

They say the deposition was given based on a promise from then-DA Bruce Castor that Cosby would never be charged in connection with this case.

Castor says he made the promise, so Cosby would not be able to plead the 5th during the civil trial. Cosby raised the Castor-promise back in February in an effort to get charges tossed.
