Another Local Lawsuit Filed Against Amtrak

PHILADELPHIA (CBS) -- The lawsuits are piling up against Amtrak for two deadly derailments in the Philadelphia area.

The high powered legal team of Tom Kline and Bob Mongeluzzi have filed suit against Amtrak on behalf of the son and daughter of Joe Carter.

He was the 61-year-old Amtrak backhoe operator who was killed by a train in Chester two months ago.

A co-worker was also killed and dozens of passengers were injured.

Train 89 was heading south in Chester when it hit a piece of equipment and derailed. But Kline says the train was on the wrong track, and he blames that on a systematic breakdown.

The plaintiff's attorneys say they want to know why there was so much confusion and why Amtrak's automatic warning technologies did not kick in.

Kline and Mongeluzzi are also representing plaintiffs in cases related to last year's deadly Amtrak derailment.
