Attorney For Officer In Eric Garner Death: NYPD Surgeon Ruled There Was No Chokehold
NEW YORK (CBSNewYork) - The NYPD officer accused of using excessive force in the death of Eric Garner had another hearing Thursday.
Officer Daniel Pantaleo is accused of using a chokehold, a maneuver banned by the NYPD.
Garner died in 2014 after police tried to arrest him for selling cigarettes illegally on Staten Island. Garner, who was asthmatic, complained he couldn't breathe.
During the pretrial hearing, Pantaleo's attorney announced that at the time of the incident, the NYPD Chief Surgeon Eli Kleinman said there was no chokehold.

Stu London said Police Commissioner James O'Neill asked Kleinman to review the video of the encounter, and Kleinman said after watching it no chokehold occurred. Kleinman also reviewed a second video of the encounter.
Pantaleo's disciplinary trial is set for next month to determine if he'll remain on the force.
A grand jury decided not to indict Pantaleo. He does not face criminal charges.
