$6 Million Settlement For Family Of Danroy Henry, Pace Student Shot Dead By Police Officer

WHITE PLAINS, N.Y. (CBSNewYork) -- A settlement was reached Monday in the 2010 police-involved shooting that killed Pace University football player Danroy "D.J." Henry Jr..

As CBS2's Dick Brennan reported, Henry was shot through the windshield of his car as he drove away from a disturbance outside a bar in Thornwood on Oct. 27, 2010.

Pleasantville police Officer Aaron Hess had knocked on Henry's window, yelled for Henry to stop, and stepped in front of his car before he landed on the hood and opened fire.

The officer was hit as Henry braked. Another man in the car was wounded.

On Monday, Henry's family accepted a settlement of $6 million dollars from the Village of Pleasantville and Hess.

As WCBS 880's Stephanie Colombini reported, the decision relieves the Village of Pleasantville and Hess from any further liability in the case.

"It means they have some degree of closure, but to monetize the death of a child is impossible," said attorney Michael Sussman.

Henry's family will work toward helping others, the attorney said.

"While this aspect of the lawsuits has now been resolved, they will continue to deal with their deep loss by focusing on faith, family and the important work of the D.J. Henry Dream Fund, which has provided opportunities for thousands of young people and will continue to do so," Sussman said in a news release.

The family also is still suing the town of Mount Pleasant because they claim officers failed to respond to his gunshot wounds.

Last year, the U.S. Attorney's office determined that it would not file civil rights charges in the shooting.
