Charges Dropped For Man Who Says Police Planted Gun On Him In Brooklyn
NEW YORK (CBSNewYork) -- A judge on Thursday threw out gun possession charges against a man who claimed police planted a firearm on him.
As WCBS 880's Irene Cornell reported, Brooklyn Supreme Court Justice Dineen Riviezzo dropped the gun possession charges against Jeffrey Herring, 53, which were lodged in June 2013 in East Flatbush, Brooklyn.
Meanwhile, Brooklyn District Attorney Kenneth Thompson said his office will investigate the case, and other similar cases made by the same police officers, in which defendants claimed guns were planted on them.
In this case, Herring was arrested as he stood next to his bicycle outside his apartment.
He had allegedly just gone shopping, and had several plastic bags with him, according to a New York Times report.
A plainclothes officer claimed he saw Herring remove a gun from a white plastic bag and transfer it into a black plastic bag before throwing it into the bushes, the newspaper reported.
Judges in this and some other cases had been skeptical of the police version of events, the newspaper reported.
