Ohio State wants "sexualized culture" band lawsuit tossed
COLUMBUS, Ohio --Lawyers for Ohio State University have asked a judge to dismiss a lawsuit by aformer marching band director fired for allowing a "sexualized culture" within the school's band.
Jonathan Waters was fired in July 2014 after the university says he mishandled sexual discrimination allegations and ignored provocative band traditions such as hazing that included members marching in their underwear.
Waters denied wrongdoing and filed a federal civil rights lawsuit claiming reverse gender discrimination.
The university's request to dismiss the suit was filed under seal March 15 and is not public. The document's existence surfaced in a separate filing seeking an extended timeline for responses. A university spokesman said he could not comment on litigation.
The court gave Waters until May 6 to oppose the school's motion.
