Twin brothers accused of fatal N.Y. stabbing

ROCHESTER, N.Y. -- A murder indictment for one twin in the murder of a 16-year-old boy in Rochester, N.Y., has been dropped temporarily, according to CBS affiliate WROC.

The station reported that Juan Mojena's case will be heard by a new grand jury. Juan had been accused of murder along with his twin brother, Darvis Mojena.

Darvis Mojena and Juan Mojena are accused of stabbing and beating Trenton Nelson to death at a bus stop on June 2. Darvis Mojena was on probation for a prior attempted burglary conviction at the time of the stabbing, the station reported.

Darvis Mojena's was adjourned yesterday, pending the outcome of developments in Juan Mojena's trial.

According to his attorney, Juan Mojena did not have the chance to adequately testify before the grand jury. The judge decided to drop the murder indictment against him and it will be decided by Friday what charges, if any, Juan faces.

The brothers will be back in court on August 3.
