Family: Georgia man mistakenly shot by police has died

STOCKBRIDGE, Ga. -- A Georgia man shot by a police officer who went to the wrong house has died, a lawyer for his family told CBS affiliate WGCL.

William "David" Powell, 63, was shot in the neck early Wednesday morning by a Henry County police officer, according to the Georgia Bureau of Investigation. He died Thursday evening, according to attorney Keith C. Martin.

"We have been notified that special agents of the GBI wish to speak to Mrs. Powell and, when she is available, we will meet with the investigators and cooperate in every way," Martin said in a statement.

WGCL reported someone called 911 shortly before midnight Tuesday to report hearing a woman yelling for help and gunshots.

The GBI said a preliminary review of the 911 call indicates the three officers who responded went to the wrong home in Stockbridge, southeast of Atlanta.

A GBI spokesperson said officers reportedly identified themselves and stayed in the driveway. They said Powell came out of his garage with a gun and that's when there was an encounter.

Neighbors had a different story, telling WGCL a light was flashed into Powell's house.

"If you're a cop, you don't go up to someone's house and start shining your light in their window," Powell's next door neighbor told the station.

A GBI spokesperson would not confirm or deny that officers shined a flashlight into the home, or even knocked on the front door. The homeowner's shooting was the second officer-involved shooting that week.

The officer who shot Powell was placed on administrative leave.
