Atty: Turn over evidence or dismiss charges in Holly Bobo case
DECATURVILLE, Tenn. - A Tennessee attorney representing one of the men charged in the kidnapping and killing of nursing student Holly Bobo has filed motions asking that evidence be turned over, charges be dropped or the prosecutor be held in contempt.
Zachary Adams and Jason Autry were charged last spring with murder and kidnapping and both have pleaded not guilty.
The 20-year-old Bobo was last seen April 13, 2011, when she went missing from her Decatur County home. Her remains weren't found until September 2014, just months after the first arrests were made in the case.
Adams has been in jail since March 2014 and Autry has been in jail since April 2014.
CBS affiliate WTVF reports attorney John Herbison, who helps represent Autry, filed the motions Tuesday at the Decatur County courthouse. Herbison says the judge ordered prosecutors to turn over the evidence to defense attorneys by the end of December 2014.
"The U.S. Constitution entitles us to know that he's charged and why and we don't have the why," said Fletcher Long, who along with Herbison is part of Autry's defense team.
Three district attorneys have prosecuted the case since Autry was charged, but Herbison says his client's trial has been unnecessarily delayed and he's running out of patience.
A date to hear the motions hasn't been set.
