Toyota Appeals $11 Million Jury Award From 2006 Fatal Crash
MINNEAPOLIS (AP) — Toyota Motor Corp. is asking a federal appeals court to overturn a jury's $11 million award resulting from a fatal crash in Minnesota.
Lawyers for the automaker filed a brief notice of appeal with the 8th U.S. Circuit Court of Appeals on Tuesday.
A jury in February determined that Toyota was 60 percent to blame for the 2006 crash in St. Paul, which left three people dead and two seriously injured.
The lawsuit alleged the crash was caused by a throttle design defect in a 1996 Camry that caused it to suddenly accelerate and crash into another car. But Toyota argued there was no defect and that driver Koua Fong Lee accidentally hit the gas instead of the brake.
The trial judge earlier rejected Toyota's request for a new trial.
