North Dakota Man To Plead Guilty To Assaulting Officer

BISMARCK, N.D. (AP) — A man says he will plead guilty to assaulting a Bureau of Indian Affairs officer on the Fort Berthold Reservation.

Benedict Frank Heart Sr., of New Town, is charged in federal court with assaulting and resisting a federal officer. The charge carries a maximum penalty of 20 years in prison.

Authorities say the 32-year-old Heart attacked and injured the BIA officer in June.

Heart is also charged in Burleigh County Court with simple assault for allegedly hitting a fellow inmate in the back of the head in September while he was being held in a Bismarck jail.

A federal public defender could not be reached for comment Thursday. A plea hearing has not been scheduled.
