Byron Smith's Attorney Files Appeal Documents
MINNEAPOLIS (WCCO) – The attorney of the Little Falls man convicted for murdering two teens on Thanksgiving Day 2012 said he filed appeal documents Wednesday in the state Supreme Court.
Steve Meshbesher filed the documents on behalf of Byron Smith. He is appealing Smith's first-degree murder convictions, saying that Smith did not get a fair trial.
In April, a jury found the 65-year-old guilty of first-degree and second-degree murder in both the deaths of 18-year-old Haile Kifer and 17-year-old Nick Brady.
Smith had shot the teens multiple times in his basement after they'd broken into his home. Following the killings, he waited a day before getting into contact with authorities.
After the sentencing, Meshbesher said that the jury did not see all the evidence.
The judge had excluded evidence about the teens' histories from the trial, including court documents that showed that Brady had broken into Smith's house and garage before.
Smith is currently serving life in prison.
