MIAMI BEACH (CBSMiami) - A 9-year-old's uncle, who she considered a father, is behind bars Thursday after he allegedly beat her and forced her into a dumpster.

And there was also testimony inside the Children's Courthouse and Juvenile Justice Center that the girl and her 5-year-old brother had been stabbed by the uncle a year but no action was taken because police were not called, even though an aunt was also living at the apartment.

A visibly shaken Child Protective investigator testified that the uncle who the girl referred to as her "father" had been violent before. The investigator testified that he stabbed the children while they were having a game of "Paddycake."

"He grabbed the knife and stabbed the two children," the investigator testified. "The boy still has stab wounds on his back."

He also testified that there was another instance at the home in which he told the children that might wake up with a "knife in their mouth."

The uncle, Jesus Crys, 30, was arrested Wednesday after police responded to a call about a child being placed in a garage dumpster.

Crys was in court Thursday and was held on no bond.

After investigating, it was revealed that Crys is the 9-year-old girl's uncle that the she refers to him as her father, according to the arrest report.

CBS4 obtained video that captured the incident.

The video captures the pair walking to a dumpster after, according to police, an argument broke out.

The girl's uncle, according to the report, removed the girl from her room because she was lying. He instructed her to get into the dumpster and when the child questioned his instructions, Crys reportedly struck her with a closed fist.

"So this little girl having been moved from point a to point b and told to get into the dumpster as the officer alleges in affidavit, so that he can quote 'get a new one' meaning replace this child this is absolutely terrorizing this child," said Assistant State Attorney Laura Adams.

Afraid, the girl climbed into the dumpster. Crys reportedly struck her a few more times.

The two returned to their home.

The officers, "fearing for the child's safety," entered through an open glass door and the Crys was taken into custody.

The child suffered minor injuries and was treated at Mount Sinai Hospital.

Neighbors who witnessed the alleged abuse called 9-1-1.

It's a real shame, it's a shame," said neighbor Peter Fischer.

Crys, who has several prior arrests including drug possession and theft, was booked and is facing several charges including kidnapping and child abuse and is being held without bond.

Department of Children and Families was notified about the incident.

At the hearing at the Juvenile Justice Center, Judge Cindy Lederman spoke with both the 9-year-old girl and her brother and said they would be placed in temporary foster care and would stay together and attend the same school together.

It was not clear where the children's mother and father are.

There will be another hearing before Judge Lederman on February 25th.
