Man Charged In Deadly Dania Beach Hit & Run Faces Judge

DANIA BEACH (CBSMiami) -- The man charged in a Dania Beach hit and run case that killed one child and left another hospitalized faced a judge on Friday.
Zachary Benjamins, 22, was in court asking the judge to change his bond. At this time, he is under house arrest, unemployed and,according to legal documents, "unemployable since he cannot leave his house."
Benjamins' attorney was asking the judge to allow him to leave his home to find a job in order to help out since he is leasing an apartment with his girlfriend.
The judge denied the request.
All this as the surviving brother, Kelvron Florence, 14, sat in the courtroom with his parents.
The late Apollo Brown, Jr., 8, and Kelvron Florence were struck on December 8th, at 100 Bryan Road while walking home from a basketball game.
Both were taken to Memorial Regional Hospital. Weeks later, 8-year old Apollo Brown died.
A tip from a community member lead police to Benajmins.
The attorney for the state said Benjamins confessed to the hit and run after being taken into custody. Also, he admitted that he had been drinking.
Benjamins has been charged with failure to remain at an accident scene involving a death, failure to stop at an accident scene involving a serious injury and tampering with evidence.
Deputies had also arrested Benjamins' girlfriend Anaee Barbeito for Insurance fraud, tampering with evidence and accessory after the fact.
