Broward Judge Agrees To Suspension After DUI Incident

TALLAHASSEE (CBSMiami/NSF) - A Broward County circuit judge has agreed to a 90-day suspension without pay as a disciplinary measure for reportedly driving under the influence.

Judge Lynn Rosenthal was charged with DUI after an accident on May 27th, 2014 at the Broward County Courthouse when she clipped a deputy's marked cruiser. She claimed she had taken an accidental overdose of a prescription sleeping aid the night before the crash.

According to the Sun Sentinel, the state's Judicial Qualifications Commission, which oversees allegations of judicial misconduct, made its recommendation to the Florida Supreme Court in a filing made public Monday.

The filing also shows that Judge Rosenthal would receive a public reprimand, 12 hours of legal ethics training and family counseling.

The panel found Rosenthal provided "satisfactory, credible evidence" that her doctor had prescribed an incorrect dose of the sleep aid Ambien CR. The charge was later reduced to reckless driving, and Rosenthal entered a no-contest plea.

The Judicial Qualifications Commission panel took issue, however, with Rosenthal's refusal after her arrest to submit to a urine and blood sample, the erasure of records from her cell phone and misleading or incomplete statements, according to the documents filed at the Supreme Court on Friday.

The panel and Rosenthal entered an agreement, known as a stipulation, that recommends to the Supreme Court that she receive a reprimand and a 90-day suspension.

The Supreme Court still has to approve the agreement.
