PLANTATION (CBSMiami) -- The father accused of deserting his teen son in Plantation may be off the hook.

Bruce Jorgensen's attorney said he will not face any charges in the disappearance of his son 16-year old Aage.

Jorgensen kicked his son out of his car back in December during a fight. Aage has not returned home since.

In an interview last month, Jorgensen denied deserting the teen and went over the efforts he's taken to find his son.

Jorgensen said he had told his son to walk home to their Plantation condo after kicking him out of the car.

Plantation Police said Jorgensen failed to file a police report on his missing son and was uncooperative with investigators.

Jorgensen argues he did not go immediately to the police since Aage had run away before and he was always able to find him with the help of a private investigator.

Police arrested Jorgensen as they say he was about to board a flight out of the country on a one way ticket but Jorgensen said he had a round trip ticket and was headed to the Northern Mariana Islands for a court hearing.

Aage has been spotted twice since he disappeared.
