Accused Fatal Hit & Run Driver Bonds Out Of Jail

DANIA BEACH (CBSMiami) - Zachary Benjamins, the accused hit and run driver that ran down two brothers, killing one, is out of jail after his bond was reduced.

Benjamins left in silence Tuesday, not speaking a word as reporters asked questions.

The bowling alley bartender is accused of hitting brothers Kelv-ron Florence and AJ Brown with his car as the boys walked home on Bryan Road in Dania Beach in December.

Deputies said he took off, leaving the two boys on the side of the road. Eight-year-old AJ died.

AJ's godmother, Benita McKnight, was stunned to learn Benjamins was allowed to bond out.

"Just tears," said McKnight. "He [Benjamins] has his family, we can't hug AJ no more, it's over, but he has family, we don't have him no more."

Benjamins is wearing an ankle bracelet to monitor him while he's out.

"We look at this as not being fair," said McKnight. "He didn't show no remorse in court, he could have at least said sorry.  He didn't show no type of remorse whatsoever!"

The family shared pictures of their older son, Kelv-ron.

Last week the 14-year-old had a tracheotomy to help him breath.

"Right now he's on a lot of medical stuff," said McKnight.  "He's medically induced and they bringing him up slowly because he's in a lot of pain.  He has a lot of broken bones, overall he's coming around."

While Benjamins is staying quiet, family and friends of the two boys are not.  They plan to show up near Benjamins' house.

"The plan is to march in the neighborhood to promote awareness," said family friend Frank Cornelius. "…to the neighborhood that this guy did this to us and watch your kids, he may do it again to one of yours."
