Woman Released On Bail After Riverside Judge Overturns 2003 Murder Conviction
LOS ANGELES (CBSLA.com) — A woman is getting a second chance at life after her 2003 murder conviction was overturned Friday by a Riverside judge.
The judge ordered that Kimberly Long's 2003 conviction for the murder of her boyfriend to be overturned and that Long will face a new trial in the future.
Prosecutors told the jury that Long bludgeoned her boyfriend, Ozwaldo Conde, in their home, before changing clothes and getting rid of the murder weapon.
Judge Patrick Magers ruled that the jury did not hear evidence that Long did not change her clothes that night, and he said there is little question the murderer would have been splattered with the victim's blood.
The judge would not go so far as to declare Long not guilty, so the District Attorney's Office will have the option to retry the case.
In the meantime, Long was allowed to post bail and to be reunited with her family.
She was in tears when the judge made it clear he intended to release her from custody by allowing her to post bail.
