Murder Charges Filed Against Boy, 15, In Pico Rivera Home-Invasion Robbery
DOWNEY (CBSLA.com) — Murder and other charges were filed Friday against a 15-year-old boy police say was involved in a fatal Pico Rivera home-invasion robbery.
Angel Emilio Estrello, who was charged as an adult, is scheduled to be arraigned Friday in Downey on one count each of murder and first-degree burglary and two counts of home-invasion robbery in connection with the stabbing death of Sergio Gutierrez.
Sergio Anthony Gutierrez, the victim's 17-year-old son, and Jesus Rafael Adame, 18, were charged Tuesday with the same counts. They are scheduled to be arraigned Oct. 7 in Norwalk.
The murder charge includes the special circumstance allegation of murder during the commission of a robbery.
Gutierrez and Estrello are not eligible for the death penalty because of their ages, but could face a maximum sentence of life in prison without the possibility of parole if convicted. Prosecutors will decide later whether to seek the death penalty against Adame.
Prosecutors say Gutierrez, 50, was attacked by the three in his home early last Saturday.
The three are accused of stealing cash, credit cards and the family vehicle from the residence.
