Trial Ordered For Howell Man In Alleged Road Rage Killing
HOWELL (WWJ/AP) - A 69-year-old man has been bound over for trial in an alleged road rage killing in Livingston County.
Derek Flemming was shot in the head in September after getting out of his vehicle to confront Martin Zale about his aggressive driving. It happened Sept. 2 in Genoa Township, 45 miles northwest of Detroit.
District Court Judge Carol Sue Reader ruled following a hearing Friday that there is probable cause to send the case to Circuit Court.
Flemming's testified at the hearing that she and her husband were en route to pick up their children when the incident occurred. She sat in the car as she watched her husband approach Zale's pickup truck at a traffic light, testifying that she saw him collapse after he was shot.
Zale remains jailed without bond.
Defense lawyer Melissa Pearce has said she will argue self-defense, and says "the whole story has not been told."
