AG Action Forces 123 Mountain To Halt Internet Sales

FRISCO, Colo. (CBS4) – A Summit County judge has forbidden Colorado outdoor retailer 123Mountain from selling its products online.
On Wednesday, Judge Terry Ruckriegle granted a temporary injunction filed by Colorado Attorney General Cynthia Coffman. The move follows hundreds of consumer complaints filed with the Better Business Bureau and other online review sites.
According to the BBB, which gave 123Mountain an F rating, many of the complaints were from consumers who never got the product they ordered, or received the wrong product and had difficulties making returns.
The injunction orders the owners of 123Mountain, Olivier and Anna Sofia Goumas, to stop "accepting orders for merchandise via the internet" and stop selling any merchandise that "Defendants do not currently have in their physical possession." The court also ordered 123Mountain to deactivate its website and also a second website, summitwearhouse.com, which is believed to be an attempt to rebrand the store under a different name after news of consumer complaints became widespread.

The court also prohibits the Goumases from setting up online shops on Facebook, Craigslist, EBay and other online sites.
As CBS4 reported in March, the Summit County Sheriff raided 123Mountain's brick and mortar store in Frisco seizing thousands of dollars-worth of skis, boots and other high end equipment to pay back creditors. The next day, CBS4 spotted Olivier Goumas cleaning out any remaining items from the store. Instead of answering our questions, Goumas covered the windows.
Last week, the Summit County Sheriff evicted 123Mountain from its store in Frisco. The property owner tells CBS4 he hadn't received rent since last November.
