Michael Jordan Expected In Chicago Courtroom Tuesday In Lawsuit Filed Against Dominick's

(CBS) -- Superstar Michael Jordan is expected to be in federal court Tuesday morning here in Chicago - where he's suing the parent company of the now-defunct Dominick's for running an ad six years ago which used Jordan's name.

The ad was in a Sports Illustrated commemorative edition marking Michael Jordan's entry in the Hall of Fame.

It read, "Congratulations Michael Jordan" and under that, a large 23 - Jordan's number.

Under that - it said, "You are a cut above," following by a Dominick's coupon for 2 dollars off a Rancher's Reserve cut of steak.

"This case is about protecting Michael Jordan's right to control who uses his identity - and how they use it," said Frederick Sperling, Jordan's attorney.

Jordan is asking for more than $5 million in the lawsuit.

The trial is expected to last at least through this week.

Sperling tells WBBM, "This case is important to Mr. Jordan and he will be there."
